USCIS Extends Immigrant Work Permits by 540 Days to Avoid Employment Status Loss

The United States Citizenship and Immigration Services (USCIS) has announced a significant extension for certain immigrant work permits, including those from India, to avoid the potential loss of employment status for many individuals. Here’s what you need to know about this important update.

Effective April 8, USCIS will automatically extend the validity period for Employment Authorization Documents (EADs) from the current 180 days to an extended period of 540 days. This temporary change aims to benefit two specific groups:

  1. Those who filed applications for Form I-765 on or after October 27, 2023, and have pending applications on April 8, 2024.
  2. Individuals who will file Form I-765 applications between April 8, 2024, and September 30, 2025.

The extension is designed to prevent EAD holders from losing their employment status, particularly for those facing a potential status loss on April 24, 2024. This move allows qualifying immigrants to maintain their employment eligibility for an additional 360 days until their EADs are renewed.

USCIS Director Ur M. Jaddou commented on the temporary rule, stating, “Over the last year, the USCIS workforce reduced processing times for most EAD categories, supporting an overall goal to improve work access to eligible individuals.” However, the agency also faced a record number of employment authorization applications, impacting renewal mechanisms.

Jaddou further explained, “Temporarily lengthening the existing automatic extension up to 540 days will avoid lapses in employment authorizations. At the same time, this rule provides DHS with an additional window to consider long-term solutions by soliciting public comments and identifying new strategies.”

The statement released by USCIS highlighted the agency’s efforts to manage immigration challenges, including the removal or return of over 617,000 individuals, predominantly those crossing the Southwest Border, since May 12, 2023, to March 13, 2024. These actions reflect the government’s ongoing efforts to address immigration issues while ensuring eligible individuals can maintain their employment benefits.
