TikTok Fights Back with Lawsuit Against US Law Mandating Sale or Ban

TikTok and its parent company ByteDance have taken legal action against a new law signed by President Joe Biden that requires the divestiture of the popular short video app or faces a ban in the United States. The lawsuit, filed in the U.S. Court of Appeals for the District of Columbia Circuit, challenges the constitutionality of the law and seeks to block its enforcement.

The law, signed by President Biden on April 24, stipulates that ByteDance must sell TikTok by January 19 or risk being banned in the country. TikTok and ByteDance argue that this law violates the First Amendment’s free speech protections and represents an unprecedented overreach by Congress.

In their lawsuit, TikTok and ByteDance argue that forcing the divestiture is not feasible from commercial, technological, or legal standpoints. They assert that the law will effectively shut down TikTok by January 19, 2025, impacting the platform’s 170 million American users who rely on it for communication and expression.

This legal battle is the latest move by TikTok to fend off efforts to shut it down in the United States. The company faces pressure from competitors like Snap and Meta, who seek to capitalize on TikTok’s uncertain political situation to gain advertising revenue.

The concerns over TikTok’s operations stem from worries among U.S. lawmakers about data privacy and national security risks, particularly regarding Chinese access to American user data. However, TikTok has consistently denied any allegations of data sharing with the Chinese government, labeling them as speculative.

The law not only mandates the divestiture of TikTok but also prohibits app stores from offering the platform and bars internet hosting services from supporting it unless ByteDance complies with the divestiture deadline. TikTok and ByteDance argue that China’s government has made it clear they will not allow the divestment of TikTok’s recommendation engine, which is crucial to its success in the U.S.

TikTok has invested significant resources, including $2 billion in data protection measures and negotiations with the Committee on Foreign Investment in the United States (CFIUS), to address national security concerns. However, discussions with CFIUS stalled, leading to the current legal battle.

President Biden has the authority to extend the January 19 deadline by three months if progress is made. The outcome of this lawsuit will have far-reaching implications for the future of TikTok in the United States and the broader landscape of internet and technology regulation between the U.S. and China.
